These terms explain the rules for using Zooke, including subscriptions, credits, AI generation, acceptable use, ownership, third-party providers, and the responsibilities that come with using creative AI tools at scale.
Acceptance and eligibility
These Terms of Service govern your access to and use of Zooke websites, applications, APIs, hosted tools, and related services. By accessing or using Zooke, you agree to these Terms and our Privacy Policy.
You may use Zooke only if you can form a binding agreement under applicable law. If you are using Zooke on behalf of a company, team, or other organization, you represent that you have authority to bind that organization to these Terms.
If you are below the age of majority in your location, you may use Zooke only with the involvement and consent of a parent or legal guardian.
Accounts and security
You are responsible for maintaining the confidentiality of your account credentials and for activities that occur under your account. Keep your login, recovery codes, payment methods, and connected integrations secure.
You must provide accurate information, keep your account details reasonably up to date, and notify us promptly if you suspect unauthorized access, abuse, or a security issue affecting your account or content.
- Do not share account access in ways that bypass seat, subscription, or usage limits.
- Do not impersonate another person, business, or public figure.
- You remain responsible for content generated or submitted through your workspace.
Plans, billing, credits, and refunds
Certain Zooke features require a paid plan, prepaid credits, or usage-based charges. Pricing, usage limits, included models, and available payment methods may vary by plan, region, or product surface.
Unless otherwise required by law or stated in a specific written offer, subscription fees are billed in advance, prepaid credits are non-cash and non-transferable, and unused credits do not carry independent monetary value.
You authorize Zooke and our payment providers to charge the payment method you provide for recurring subscriptions, add-ons, taxes, duties, and fees associated with your use of the Services.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
- Taxes, exchange costs, and processor fees may apply depending on your jurisdiction and payment method.
- If a payment fails, we may suspend or limit features until payment is successfully collected.
- Refunds, credits, and goodwill adjustments are handled case by case, subject to applicable consumer law and any product-specific commitments.
Acceptable use
You may not use Zooke for unlawful, harmful, fraudulent, deceptive, or abusive activity. You also may not use the Services in ways that violate the rights of others, compromise security, or interfere with the normal operation of the platform.
Certain workflows may involve AI-generated images, videos, audio, text, or avatars. You are responsible for ensuring your prompts, source files, reference materials, and resulting outputs comply with applicable law, platform policies, and the rights of others.
- No exploitative sexual content, child sexual abuse material, or sexualized content involving minors.
- No harassment, threats, targeted abuse, non-consensual intimate imagery, or doxxing.
- No malware, credential theft, fraud, phishing, or attempts to bypass platform safeguards.
- No infringement, piracy, or submission of material you do not have the right to use.
- No sanctioned, embargoed, or export-restricted use that violates applicable trade controls.
Your content, prompts, and outputs
You retain ownership of the inputs you submit to Zooke to the extent you own them. You grant Zooke and our subprocessors a worldwide, non-exclusive license to host, store, reproduce, transmit, transform, and otherwise process your inputs and outputs as needed to operate, secure, troubleshoot, improve, and support the Services.
AI-generated output may not be unique, may resemble content generated for others, and may contain inaccuracies, style overlap, or unexpected artifacts. You are responsible for reviewing outputs before publishing, distributing, relying on, or commercializing them.
If you submit source images, brand materials, likenesses, voices, logos, or other protected assets, you represent that you have all rights, permissions, and releases necessary for the intended use.
Intellectual property and platform rights
Zooke, including our software, interfaces, visual design, trademarks, branding, compilations, and underlying service architecture, is protected by intellectual property and other laws. Except for the limited rights granted in these Terms, we reserve all rights not expressly granted to you.
You may not copy, reverse engineer, resell, frame, scrape, or create derivative services from Zooke except as allowed by applicable law or with our prior written permission.
Third-party models, integrations, and content
Zooke may route requests through third-party model providers, cloud infrastructure providers, payment processors, analytics vendors, storage vendors, and other service providers. Their terms, policies, availability, technical limits, and moderation requirements may also apply to specific features.
We are not responsible for third-party services or content beyond our direct control, including outages, policy changes, blocked requests, provider-side moderation, or external platform downtime.
Availability, changes, and beta features
We may add, remove, update, suspend, or discontinue features, models, limits, integrations, and pricing at any time. Some surfaces may be labeled beta, preview, experimental, or early access and may change more frequently or be less stable.
We do not guarantee uninterrupted availability, permanent feature parity, or that any specific model, provider, or generation workflow will remain available for any minimum period.
Disclaimers
To the maximum extent permitted by law, Zooke is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation.
You should not rely on Zooke outputs as a substitute for professional advice in legal, medical, financial, employment, safety-critical, or other high-risk contexts without independent review by a qualified professional.
Limitation of liability
To the maximum extent permitted by law, Zooke and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, business opportunities, or business interruption arising out of or related to the Services.
To the maximum extent permitted by law, our aggregate liability for claims arising out of or relating to the Services will not exceed the greater of the amount you paid to Zooke for the specific service giving rise to the claim during the twelve months before the event, or one hundred U.S. dollars.
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.
Indemnity
You agree to defend, indemnify, and hold harmless Zooke and its affiliates, personnel, licensors, and service providers from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from or related to your content, your use of the Services, your violation of these Terms, or your violation of any law or third-party right.
Suspension and termination
We may suspend, restrict, or terminate access to all or part of the Services if we believe it is reasonably necessary to protect users, comply with law, prevent abuse, investigate misconduct, respond to security concerns, or enforce these Terms.
You may stop using Zooke at any time. Provisions that by their nature should survive termination, including payment obligations, disclaimers, limitations of liability, and dispute-related provisions, will survive.
International use, sanctions, and local rights
Zooke is offered to users worldwide, but access to specific models, payment methods, or features may vary by jurisdiction. You are responsible for complying with the laws applicable to your use, including export controls, sanctions, advertising rules, privacy rules, and local consumer protection requirements.
Nothing in these Terms limits non-waivable rights you may have under mandatory law in your country or region of residence.
